1. Acceptance of these Terms
These Terms & Conditions ("Terms") govern your access to and use of digiflyx.marketing and its related pages (the "Site"), operated under the DigiflyX brand.
By using the Site or submitting an enquiry, you agree to these Terms. If you do not agree, please do not use the Site. You must have the legal capacity and authority required to provide information or make an enquiry for yourself or an organisation.
2. Website information and enquiries
The Site provides general information about DigiflyX's marketing, advertising, lead-generation, creative, automation and related services. Site content is not a binding offer, professional advice or a promise that we will accept an engagement.
When submitting an enquiry, you must provide information that is accurate and that you are authorised to provide. Submission asks DigiflyX to contact you about that enquiry, including by telephone or WhatsApp where appropriate. It does not create a client relationship or guarantee delivery of any service.
3. Client engagements
A client relationship begins only when DigiflyX and the client agree to a separate written proposal, statement of work or service agreement. That document will govern the agreed scope, deliverables, fees, advertising spend, timelines, approvals, payment and cancellation terms.
If a separate written agreement conflicts with these website Terms, the separate agreement controls for that client engagement.
Packages, prices, turnaround times or service descriptions displayed on the Site are indicative unless expressly stated otherwise in an accepted written agreement. They may vary according to business category, campaign feasibility, platform requirements and project scope.
4. Marketing results
Marketing performance is variable. DigiflyX does not guarantee a particular number or quality of leads, cost per lead, return on advertising spend, revenue, ranking, reach, conversion rate, account approval or other business result.
Outcomes depend on factors that may include the offer, budget, competition, audience, targeting, creative material, platform systems, market conditions and the client's sales and follow-up process.
Case studies, testimonials, dashboard images and campaign figures describe particular circumstances or illustrative interfaces. They are not promises of typical or future performance. See our Disclaimer for more detail.
5. Your responsibilities and acceptable use
You must not use the Site to:
- break any law or infringe another person's rights;
- submit false, misleading, harmful or unauthorised material;
- impersonate another person or organisation;
- interfere with Site security, performance or availability;
- introduce malicious code or attempt unauthorised access; or
- scrape, copy or exploit the Site through improper automated means.
Materials supplied for services
A client supplying claims, offers, testimonials, customer data, trademarks, images or other material must have the necessary rights, permissions and substantiation. Clients remain responsible for reviewing and approving campaign claims and ensuring their products, services and sales practices meet applicable requirements.
DigiflyX remains responsible for its own duties under applicable law and may refuse or remove material reasonably believed to be unlawful, deceptive, infringing or contrary to platform policy.
6. Intellectual property
Unless otherwise stated, Site text, design, graphics, branding, code and original media are owned by or licensed to DigiflyX and are protected by applicable intellectual-property laws.
You may view the Site for legitimate personal or business-evaluation purposes. You may not reproduce, modify, republish, sell, remove ownership notices from, or commercially exploit Site content without prior written permission. Third-party names, logos and trademarks remain the property of their respective owners.
7. Third-party platforms and links
The Site may refer or link to independently operated services such as Meta, Facebook, Instagram, WhatsApp or Google. Their terms, privacy practices, review systems and availability apply when you use them.
DigiflyX does not control platform approval decisions, account restrictions, algorithm changes, outages, reporting or attribution systems. A link or reference does not by itself imply sponsorship, endorsement or affiliation.
8. Availability and accuracy
We use reasonable efforts to keep the Site useful and current, but do not promise that every page will always be available, complete, secure, error-free or up to date. Content may be corrected, updated, suspended or removed where reasonably necessary.
You should verify information that is important to a business or regulatory decision and obtain appropriate professional advice where required.
9. Limitation of liability
Nothing in these Terms excludes a statutory right or liability that cannot lawfully be excluded or limited.
To the extent permitted by applicable law, DigiflyX will not be responsible for indirect, incidental or consequential loss arising solely from reliance on general Site content, temporary Site unavailability, unauthorised misuse of the Site or independently operated third-party services.
Liability arising from a paid client engagement will be governed by the applicable written service agreement.
10. Changes to these Terms
We may update these Terms to reflect changes to the Site, services or applicable requirements. The revised version will be posted with an updated date. Continued use after an update constitutes acceptance only to the extent permitted by law.
11. Governing law and disputes
These Terms are governed by the laws of India. Before starting formal proceedings, please contact DigiflyX so the issue can be considered in good faith. Any unresolved dispute will be dealt with by courts or authorities having jurisdiction under applicable law.
